These Terms and Conditions govern all painting services provided by Picture Perfect Paint ("Company," "we," "us") to clients ("Client," "you") in Kingston, Ontario and surrounding areas. By accepting a quote, signing a contract, making a deposit, or permitting work to commence, you agree to these terms in full.

Section 01

Scope of Work & Change Orders

1.1

All work performed is defined by the written service agreement provided to the Client prior to project commencement. Verbal agreements or informal on-site requests are not binding and do not constitute scope changes.

1.2

Any work beyond the agreed scope — including additional rooms, surfaces, coats, or colour changes after work has commenced — requires a Change Order confirmed by both parties (by phone or email) before that work begins. Change Orders will specify the additional cost and any timeline impact.

1.3

Picture Perfect Paint is not obligated to perform out-of-scope work without a confirmed Change Order in place. Unconfirmed on-site requests will not be actioned.

1.4

Picture Perfect Paint reserves the right to decline additional scope requests that cannot be safely or professionally completed within the existing schedule.

Section 02

Quotes & Pricing

2.1

All quotes are valid for 30 days from the date of issue unless otherwise stated in writing.

2.2

Quotes are based on site conditions observed at the time of assessment. If concealed damage, structural issues, or significantly different conditions are discovered upon commencement, pricing may be revised. The Client will be informed before work proceeds.

2.3

Promotional discounts (including seasonal offers) apply only to projects booked and confirmed within the promotional window, as stated on the applicable marketing material.

2.4

HST is applicable to all services and will be itemized on the final invoice.

Section 03

Deposit & Milestone Payment Schedule

3.1

Payment is structured by milestone. Each milestone payment is due upon completion of that milestone and before work on the next milestone begins. Specific amounts for each milestone are defined in the signed project contract.

3.2

The standard payment structure is as follows: (i) Deposit — due at contract signing to secure materials and booking date; (ii) Milestone 1 — due end of Day 1 upon completion of all prep work including repair, sanding, priming, and masking; (iii) Milestone 2 — due upon completion of the first coat applied to all surfaces; (iv) Milestone 3 — due upon completion of final coat, trim, ceilings, and detail work; (v) Final Balance — due at project completion following a passed walkthrough and confirmed touch-ups.

3.3

Payments not received within 48 hours of milestone completion will incur a late payment service charge of 1.5% per month on the outstanding balance. Picture Perfect Paint reserves the right to halt all work until the outstanding milestone payment is received.

3.4

Failure to remit payment at any milestone constitutes grounds for immediate work stoppage. The Client remains liable for all completed milestone work at the per-milestone rate, plus any materials already purchased.

3.5

Accepted payment methods are cash, e-transfer (picperfect@paint.pros.com), and cheque (payable to Picture Perfect Paint).

3.6

Non-payment may result in collection proceedings. The Client agrees to be responsible for all reasonable collection costs, including legal fees, if applicable.

Section 04

Cancellation & Work Stoppage

4.1

Clients may cancel with a minimum of 72 hours notice (by phone or email) prior to the scheduled start date. In this case, the deposit is non-refundable, as it covers scheduling and material costs already committed.

4.2

Cancellation after work has commenced requires payment for all work completed to date, calculated at the per-milestone rate, plus the cost of any materials already purchased.

4.3

Picture Perfect Paint reserves the right to pause or stop work if: (i) the site presents an unsafe working condition; (ii) a milestone payment is not received within 48 hours of milestone completion; or (iii) the Client fails to provide required access or timely decisions causing the project to stall. Work resumes upon resolution. Picture Perfect Paint is not liable for delays or damages resulting from a justified work stoppage.

4.4

Picture Perfect Paint reserves the right to reschedule due to weather (exterior work), crew illness, or other unforeseen circumstances. Reasonable advance notice will be provided and no penalty applies to the Client in such cases.

Section 05

Client Responsibilities

5.1

The Client must provide clear and safe access to all work areas by the agreed daily start time. Denied access is grounds for work stoppage and may result in rescheduling costs.

5.2

The Client is responsible for removing or identifying personal items of significant value. Picture Perfect Paint will protect surfaces but is not responsible for pre-existing damage to unsecured valuables.

5.3

Pets must be secured away from active work areas for their safety and to protect freshly painted surfaces.

5.4

The Client must designate one primary point of contact for on-site approvals and be reachable by phone during working hours for real-time decisions.

5.5

The Client must review work at each milestone checkpoint and communicate any concerns before the next phase begins. Concerns raised after a milestone has been signed off and paid will be treated as post-completion claims.

5.6

The Client must ensure the workspace is at a suitable temperature and ventilation for painting (typically 10°C–32°C) and that electricity and running water are accessible for the duration of the project.

5.7

The Client is responsible for disclosing known hazards including lead paint, asbestos, mould, or structural instability before work begins. Failure to disclose known hazards that result in crew injury or project disruption may hold the Client liable.

5.8

If the Client supplies their own paint or materials, Picture Perfect Paint assumes no responsibility for the quality, coverage, or outcome of those materials. Warranty provisions do not apply to client-supplied materials.

Section 06

Surface Preparation & Limitations

6.1

Proper surface preparation — including sanding, priming, caulking, and patching — is performed as part of our standard process. Any additional repair work beyond minor defects (e.g., large holes, water damage, crumbling drywall) will be quoted separately.

6.2

Colour changes from dark to light, or high-sheen to matte, may require additional coats. Where additional coats are identified as necessary, they will be communicated and quoted before proceeding.

6.3

Texture matching and plaster repair are performed to a reasonable professional standard. Exact matching of aged or custom textures cannot be guaranteed.

6.4

Existing defects beneath the painted surface (e.g., settling cracks, substrate movement) may re-emerge after painting and are not covered under warranty.

Section 07

Warranty

7.1

Picture Perfect Paint provides a 30-day workmanship warranty from the date of project completion, covering defects in application including peeling, flaking, and lifting under normal conditions.

7.2

The warranty does not cover damage from moisture intrusion, physical impact, cleaning chemicals, structural movement, or normal wear and tear.

7.3

Deficiency claims must be raised during the final walkthrough or within the 30-day warranty period. Any deficiencies identified at the final walkthrough will be corrected before the final balance is released.

7.4

Claims raised after the Client has confirmed satisfaction at the final walkthrough and remitted final payment will be assessed on a case-by-case basis within the warranty window.

7.5

Warranty is void if painted surfaces are modified, repainted, or treated by a third party after project completion.

7.6

Warranty does not apply to client-supplied materials (see Section 5.8) or to pre-existing substrate conditions disclosed or observed prior to painting.

Section 08

Liability

8.1

Picture Perfect Paint carries general liability insurance. A certificate of insurance is available upon written request.

8.2

Our liability is limited to the direct cost of correcting deficient work within the scope of the contracted project. We are not liable for indirect, consequential, or incidental damages.

8.3

We are not liable for pre-existing damage or conditions, damage resulting from Client-directed decisions (e.g., colour choices, surfaces the Client declined to have repaired), or damage to persons who enter the active work area without authorization.

8.4

The Client is responsible for keeping children, pets, and unauthorized persons out of active work areas. Picture Perfect Paint is not liable for injury to persons who enter without authorization.

8.5

In the event of accidental damage caused by our crew during the project, we will assess and remedy the situation promptly. Claims must be raised before the final walkthrough is signed off and final payment is remitted.

Section 09

Paint Products & Colours

9.1

We use premium-grade, professional paints from reputable suppliers unless otherwise specified. Specific brands or product lines can be accommodated upon request and may affect pricing.

9.2

Colour selection is the Client's responsibility. We strongly recommend viewing physical paint chips or samples in the intended space before confirming colours.

9.3

Colour accuracy cannot be guaranteed to match digital representations, website swatches, or small test patches viewed under different lighting conditions.

9.4

Once a colour has been applied, changes requested by the Client will be treated as additional scope and quoted accordingly.

Section 10

Health, Safety & Site Conditions

10.1

Our crew follows all applicable health and safety regulations under Ontario's Occupational Health and Safety Act.

10.2

The Client must ensure that children and pets are kept clear of active work areas during the project.

10.3

Adequate ventilation must be accessible during and after painting. The Client accepts responsibility for managing ventilation in occupied spaces.

10.4

If unsafe site conditions are encountered (e.g., suspected asbestos, mould, or electrical hazards), we reserve the right to suspend work until conditions are remediated.

Section 11

Privacy

11.1

We may photograph completed work for portfolio and marketing purposes. Photos will not include identifying personal information. If you prefer your project not be photographed, notify us in writing before commencement.

11.2

Client contact information is collected solely for project coordination and will not be sold or shared with third parties.

Section 12

Dispute Resolution

12.1

In the event of a dispute, both parties agree to first attempt resolution through direct communication by phone or email.

12.2

If unresolved through direct communication, disputes will be referred to mediation before any legal action is initiated.

12.3

These Terms and Conditions are governed by the laws of the Province of Ontario. Any legal proceedings shall be conducted in Kingston, Ontario.

Section 13

Amendments

13.1

Picture Perfect Paint reserves the right to update these Terms and Conditions at any time. Updated terms will be posted on our website (thepz.ca) and apply to all projects quoted after the effective date of the revision.

13.2

Continued engagement with our services after the posting of updated terms constitutes acceptance.
